Erik Perez seemed very knowledgeable on the phone. Once i sent in the retainer i ended up with Alejandro who was nice but not as knowledgeable.Michael Majority the partner was not happy that i wanted to work with Erik. He yelled at me on the phone and said he was the boss. I told him i wanted my $3500 retainer back. it’s been one week and i have not received my money back. i would stay clear of this firm. ps we said that the one letter they sent out was over $1500.

What is the Cost of an HOA Lawyer?

When facing issues with your Homeowners Association (HOA) or Condominium Association, one of the biggest concerns for homeowners is the potential cost of hiring an attorney. It’s important to understand that the cost of an HOA lawyer depends entirely on the nature of the issue you’re dealing with and the scope of work involved. However, a good HOA attorney should do much more than just quote you a fee. They should provide you with as much information as possible about your options, the costs associated with each, and the potential outcomes, so you can make informed decisions that best suit your situation.

Understanding the Costs

Generally speaking, hiring an attorney to send a cease-and-desist letter will be less expensive than hiring an attorney to sue an association or to defend against a lawsuit. But regardless of the specific service you need, a knowledgeable HOA attorney should:

  • Provide a Clear Overview of Your Options: A good attorney will help you understand the various legal avenues available to you, whether it’s a simple letter to your association, negotiation, or taking legal action.

  • Outline the Costs: They should give you a transparent breakdown of what each option might cost, so you can plan accordingly.

  • Discuss the Pros and Cons: Your attorney should help you weigh the advantages and disadvantages of each option, based on their experience and understanding of similar cases.

  • Clarify the Risks and Gains: Every legal action comes with its own set of risks and potential benefits. A good HOA attorney will help you understand what’s at stake and what you stand to gain by pursuing a particular course of action.

The Role of an HOA Attorney: From Simple Letters to Full Lawsuits

There are many different ways an HOA attorney can help solve a problem for a homeowner, ranging from simple to more complex actions:

  • Sending a Cease-and-Desist Letter: Sometimes, all it takes is a strongly worded letter from an attorney to prompt an HOA to address an issue. This can be a relatively low-cost option that might resolve the problem quickly.

  • Negotiating with the HOA: In some cases, direct negotiation between your attorney and the HOA can lead to a resolution without the need for litigation. This approach can save both time and money while still achieving your desired outcome.

  • Pre-Suit Mediation or Arbitration: Before taking a case to court, pre-suit mediation or arbitration can be an effective way to resolve disputes. These processes are generally less adversarial than a lawsuit and can result in a binding agreement that satisfies both parties.

  • Filing a Lawsuit: If other methods don’t result in a satisfactory resolution, filing a lawsuit might be necessary. While this is typically the most expensive option, it can also be the most effective way to hold an HOA accountable and secure your rights as a homeowner.

The Peace of Mind Provided by an HOA Attorney

One of the most significant benefits homeowners experience after hiring an HOA attorney is peace of mind. Dealing with an HOA dispute can be stressful and time-consuming, especially when you’re unsure of your rights or the best course of action. An experienced HOA attorney takes on that burden for you, providing clarity and guidance every step of the way.

Why Peace of Mind Matters:

  • Expert Guidance: With an attorney handling your case, you don’t have to navigate the complex legal landscape alone. This allows you to focus on other aspects of your life while your attorney manages the legal details.

  • Confidence in Your Actions: Knowing that a professional is advocating for you helps reduce uncertainty and gives you confidence that you’re taking the right steps to protect your rights and your property.

  • Reduced Stress: Legal disputes with an HOA can be emotionally draining. An attorney can help alleviate that stress by handling communications, negotiations, and, if necessary, litigation on your behalf.

  • Better Outcomes: With an attorney’s experience and strategic planning, you’re more likely to achieve a favorable outcome, whether through negotiation, mediation, or litigation.
