What happens if I bear some responsibility for my own injury?
Suppose you were intoxicated when you fell into an unmarked hole on someone else’s property or were speeding when a driver making an illegal turn hit your car? Different states handle the problem of shared blame for accidents in different ways. Florida works under the principle of pure comparative negligence.
What this means is that in Florida you can still file a claim for damages even if you are partially responsible for the accident. However, the court will assign a percentage of blame to each party and you will only be able to receive damages for the amount awarded minus your percentage of blame. So, if you are awarded $100,000 and the court deems you to be 25 percent responsible for the accident, you will actually receive $75,000. In this context, the word “pure” means that you can sue even if you bear greater responsibility for the accident than the defendant.
